Darwin loses case against Tesla

Raglan engineer Niall Darwin has lost a legal battle against Tesla after he had a wrecked 2016 Tesla S 90D he bought in Australia rebuilt but was unable to get supercharging and software support here.

Darwin took Tesla to the Disputes Tribunal in Hamilton about the supercharging seeking $15,000 compensation.

But the tribunal ruled the Australian Tesla employee who confirmed supercharging would be available was not a Tesla New Zealand employee and therefore could not make the offer on behalf of Tesla New Zealand.

“I feel thoroughly upset and helpless,” Darwin says in one of several YouTube videos he posted about his dispute.

He says he won’t pursue the matter any further legally because he cannot afford it.

But Darwin did find a way around the issue, getting access so he can now manage and update the Tesla.

However, supercharging is still out.

    Probably wouldn’t have hurt for him to do his homework properly first, by contacting Tesla NZ. Some people expect everything for nothing.
